This policy explains how Kattz Mos Accountants & Tax Practitioners (“we”, “us”) collects, uses, shares and protects personal information, in line with the Protection of Personal Information Act 4 of 2013 (POPIA).
Who we are
Kattz Mos Accountants & Tax Practitioners is the responsible party for personal information collected through kattzmos.co.za and in providing our services. Our Information Officer is KL Mosia, Information Officer, Kattz Mos Accountants & Tax Practitioners, Shop 6 Semar Building, 404 Pretorius Street, Arcadia, Pretoria, Gauteng 0007. What personal information we collect
Through this website we collect only what you choose to give us, and limited technical information:
- Contact form: your first and last name, email address, telephone number and the content of your message.
- When you become a client: identity number, tax reference number, physical and postal address, banking details, income, asset and family information, and other documents needed for the service you ask for.
- Technical information: your IP address, browser type and the pages you visit, recorded in our web host’s server logs for security.
- Calculators and Estate Planner: the figures you enter stay in your own browser. They are not sent to us. The Estate Planner saves your figures in your browser’s local storage so you can return to them; you can clear them at any time.
Why we collect it
- To respond to your enquiry and give you a quote.
- To deliver the accounting, tax, estate and advisory services you engage us for.
- To comply with legal obligations, including the Income Tax Act, the Tax Administration Act 28 of 2011, the Companies Act and professional body rules.
- To keep the website secure and working.
- To send you tax deadline reminders or newsletters, only if you have opted in. You can opt out at any time.
Legal basis for processing (POPIA section 11)
- Consent, for example when you submit the contact form or opt in to communications.
- Performing a contract with you, or taking steps you ask for before entering one.
- Legal obligations that apply to us, such as tax and record-keeping laws.
- Legitimate interests, such as keeping the website and our systems secure.
Information sent outside South Africa
Some providers (for example Google, and cloud software providers) may store information outside South Africa. We only allow this where POPIA section 72 is met: the recipient is bound by laws, binding rules or an agreement giving adequate protection, or you have consented.
How we store and protect it
- The website uses an encrypted (HTTPS) connection.
- Access to client information is limited to staff who need it, protected by passwords and confidentiality obligations.
- We use reputable providers with appropriate security measures, and we review our safeguards regularly.
- If we believe your information has been compromised, we will notify you and the Information Regulator as POPIA section 22 requires.
Please do not send identity documents, tax certificates or banking details through the website contact form. Ask us for a secure way to send documents.
How long we keep it
We keep enquiries for as long as needed to respond and follow up, and no longer than two years if you do not become a client. Client records are kept for at least five years from the date a return is submitted, as the Tax Administration Act requires, or longer if another law, an audit or a dispute requires it. After that, records are securely destroyed or de-identified.
Your rights
Under POPIA you have the right to:
- be told that your information is being collected;
- ask whether we hold information about you, and request a copy (see our PAIA Manual);
- ask us to correct or delete information that is inaccurate, out of date, excessive or unlawfully obtained;
- object to processing on reasonable grounds, and to direct marketing at any time;
- withdraw your consent, without affecting processing that took place before;
